Smart Christian Life Insurance and Rafael Posadas (CA Lic. #0E44318) are committed to full compliance with the state and federal laws governing the marketing, solicitation, and sale of life insurance in California. This page summarizes the principal statutes and regulations that apply to this website and to our outreach to California consumers.

1. California Licensing & Producer Conduct

  • Cal. Ins. Code § 1631 & § 1633 — Licensing requirement. Rafael Posadas holds California Life-Only Agent license CA Lic. #0E44318 and is appointed by each carrier whose products are presented to consumers.
  • Cal. Ins. Code § 1725.5 — License number disclosure on print and electronic communications. Our CA license number is displayed on the home page, in this Site’s footer, and in our email signature, in 12-point or larger type, as required.
  • Cal. Ins. Code § 1724.5 & § 1726 — Use of true name and any approved “doing business as” names. We transact only under the name and DBA filed with the California Department of Insurance.
  • Cal. Ins. Code § 1722 — We are an independent producer and are not affiliated with or endorsed by any government agency, Medicare, the Social Security Administration, or any single insurance carrier.
  • Cal. Ins. Code § 785–789.10 — Senior insurance standards. When working with consumers age 65 and older, we follow the heightened duty-of-honesty, suitability, and 30-day free-look requirements that apply to life insurance and annuity sales to seniors.
  • Cal. Ins. Code § 10509.910 et seq. — Best-Interest standard for annuity recommendations.
  • Cal. Ins. Code § 10127.10 — Mandatory 10-day (30-day for seniors) free-look / right-to-return period on individual life policies.

2. California Privacy & Information Protection

  • Cal. Ins. Code §§ 791–791.27 — Insurance Information and Privacy Protection Act. Governs collection, use, and disclosure of personal and privileged information in an insurance transaction.
  • California Consumer Privacy Act / CPRA — Cal. Civ. Code § 1798.100 et seq. See our Privacy Policy for your rights to know, delete, correct, opt out, and limit use of sensitive personal information.
  • “Shine the Light” — Cal. Civ. Code § 1798.83. We do not share personal information with third parties for their own direct-marketing purposes.
  • CalOPPA — Cal. B&P Code §§ 22575–22579. This Site posts a conspicuous Privacy Policy and honors browser Do Not Track signals to the extent feasible.

3. Federal Privacy & Information Laws

  • Gramm-Leach-Bliley Act (GLBA) — 15 U.S.C. §§ 6801–6809 and 16 C.F.R. Part 314 (Safeguards Rule). As a licensed producer, we maintain a written information security program and provide an annual privacy notice describing our information-sharing practices.
  • HIPAA / HITECH — 45 C.F.R. Parts 160 & 164. Protected Health Information collected on behalf of a carrier is handled under the carrier’s HIPAA Privacy and Security Rule obligations and applicable business-associate terms.
  • Fair Credit Reporting Act (FCRA) — 15 U.S.C. § 1681. Carriers may obtain consumer reports (MIB, Rx, MVR) to underwrite your application; you have the right to know the nature and source of any adverse-action report.
  • COPPA — 15 U.S.C. §§ 6501–6506. This Site is not directed to children under 13.

4. Email Marketing — CAN-SPAM Act (15 U.S.C. § 7701)

We honor the CAN-SPAM Act in every commercial email we send:

  • No false or misleading header information or subject lines.
  • Clear identification of the message as an advertisement when applicable.
  • Inclusion of our valid physical postal address.
  • A clear and conspicuous “unsubscribe” mechanism in every commercial email, honored within 10 business days of request.
  • Maintenance of an internal suppression list — unsubscribed addresses are never re-marketed or transferred to a third party.

5. Telephone & Text — TCPA, Do-Not-Call, California § 17593

  • Telephone Consumer Protection Act (TCPA) — 47 U.S.C. § 227 and 47 C.F.R. § 64.1200. We do not make autodialed, pre-recorded, or artificial-voice marketing calls to wireless or residential numbers, nor send marketing text messages, without prior express written consent meeting E-SIGN Act requirements.
  • Federal Do-Not-Call Registry (16 C.F.R. § 310.4). We scrub outbound marketing call lists against the National Do-Not-Call Registry and our own internal do-not-call list.
  • California Connected Device Privacy Act and Cal. B&P Code § 17593. California residents may add themselves to our internal do-not-call list at any time by phone or email; we honor the request within 30 days and maintain it for at least five years.
  • SMS opt-out. Recipients may reply STOP to any text message to opt out and HELP for assistance, consistent with CTIA Messaging Principles.

6. Anti-Fraud & Anti-Money-Laundering

  • Cal. Ins. Code § 1871.7 — Insurance Frauds Prevention Act. It is unlawful to knowingly present false or fraudulent information in connection with an insurance application. Application materials carry the statutory fraud warning.
  • 31 C.F.R. Part 1025 (FinCEN AML rules for insurance companies). We assist carriers in meeting customer- identification and suspicious-activity reporting obligations on covered cash-value and annuity products.
  • OFAC sanctions screening as required by the U.S. Treasury Office of Foreign Assets Control.

7. Replacement & Suitability

  • Cal. Ins. Code §§ 10509–10509.9 — Life insurance replacement disclosure requirements. When a recommended policy would replace an existing policy, the applicant receives the required Notice Regarding Replacement and 30-day notice to the existing insurer.
  • NAIC Suitability in Annuity Transactions Model Regulation as adopted in California — best-interest analysis for all annuity recommendations.
