Smart Christian Life Insurance (“we,” “us,” “our”), led by Rafael Posadas (CA Lic. #0E44318), is committed to protecting the privacy of consumers, applicants, and policyholders who visit smartinsurance.life or otherwise interact with our services. This Privacy Policy explains what information we collect, why we collect it, how we use and share it, and the rights you have under applicable federal and California law.

1. Information We Collect

  • Identifiers: name, postal address, email, phone number, IP address, and government identifiers when needed to underwrite a policy.
  • Insurance application data: date of birth, gender, marital status, dependents, occupation, income, and coverage preferences.
  • Consumer health information: medical history, height and weight, tobacco use, and prescription history — collected only with your express consent and protected as Nonpublic Personal Health Information (NPHI) under the Gramm-Leach-Bliley Act (GLBA) and the NAIC Insurance Information and Privacy Protection Model Act (California Insurance Code §§ 791–791.27).
  • Financial information: banking, billing, and payment details required to issue and service a policy.
  • Internet activity: browsing data, referring URLs, device identifiers, and cookies collected via this website.

2. How We Use Your Information

  • To respond to quote requests, consultations, and inquiries.
  • To submit insurance applications to carriers on your behalf and service in-force policies.
  • To comply with state and federal insurance, anti-fraud, and recordkeeping laws.
  • To send transactional and policy-related communications you have requested or that we are legally required to send.

3. Federal Privacy Frameworks

Gramm-Leach-Bliley Act (GLBA) — 15 U.S.C. §§ 6801–6809

As a licensed insurance producer, we are a “financial institution” under GLBA. We provide this Privacy Notice as required by the GLBA Safeguards Rule and limit the sharing of Nonpublic Personal Information (NPI) to what is necessary to service your insurance needs or as permitted by law. You may opt out of certain sharing as described in Section 7.

HIPAA & HITECH

Where we collect Protected Health Information (PHI) on behalf of a carrier, we handle that information consistent with the Health Insurance Portability and Accountability Act (HIPAA) Privacy and Security Rules and applicable business associate agreements.

Fair Credit Reporting Act (FCRA) — 15 U.S.C. § 1681

Carriers may obtain consumer reports (including MIB, Rx, and motor vehicle reports) in connection with your application. You have the right to request the nature and substance of any consumer report and to dispute inaccurate information.

4. California-Specific Privacy Rights

California Consumer Privacy Act / CPRA (Cal. Civ. Code § 1798.100 et seq.)

California residents have the right to: (a) know what personal information we collect, use, disclose, and sell or share; (b) request deletion; (c) request correction; (d) opt out of the sale or sharing of personal information; (e) limit use of sensitive personal information; and (f) be free from retaliation for exercising these rights.

California Insurance Information and Privacy Protection Act (Cal. Ins. Code §§ 791–791.27)

This law governs how insurance institutions, agents, and support organizations collect, use, and disclose personal and privileged information. You have the right to access, correct, or amend information we maintain about you in connection with an insurance transaction.

“Shine the Light” Law (Cal. Civ. Code § 1798.83)

California residents may request a list of any personal information we disclosed to third parties for direct marketing purposes during the prior calendar year. We do not disclose personal information to third parties for their own direct marketing purposes.

California Online Privacy Protection Act (CalOPPA — Cal. B&P Code §§ 22575–22579)

This website honors browser “Do Not Track” signals to the extent technically feasible and discloses the categories of information collected through the site as described above.

7. Your Opt-Out Rights

  • Marketing email: use the “unsubscribe” link in any marketing email or contact us directly.
  • SMS / text messages: reply STOP at any time to stop messages, or HELP for help.
  • Telephone calls: request placement on our internal do-not-call list. We also honor the federal and California state Do-Not-Call registries.

8. Children

This site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 (COPPA, 15 U.S.C. §§ 6501–6506).
